| Currently there are about 150,000 divorces every year in England and Wales.
In order to get divorced you have to have been married more than a year and show that the marriage has irretrievably broken down. There are five ways is in which you can show that this is the case. These are:
- The other party has committed adultery and you find it intolerable to live with them;
- The other party has behaved in such a way that you cannot reasonably be expected to live together;
- You have been separated for two years and the other party agrees to get divorced;
- You have been separated five years;
- The other party deserted you more than two years ago.
The divorce procedure itself is usually straightforward. It is not normally necessary for either party to attend court. Usually the divorce will take between four and five months to complete, providing the divorce is not defended, but may take longer if there are financial issues to resolve as well.
Defended divorces are extremely rare and usually the divorce proceedings are undertaken without difficulty. We ensure that everything the court needs is put in place quickly and efficiently, so that no problems arise.
We can advise you whether you are bringing the divorce proceedings, or if you have been served with divorce proceedings, and can advise you at any stage, whether at the moment you are simply contemplating divorce, or if proceedings have already started.
